II. General conditions of use
1.PURPOSE OF THESE TERMS AND CONDITIONS OF USE
These Terms and Conditions of Use (hereinafter the “T&Cs”) govern access to, and use of, the Website and its contents.
The purpose of these T&Cs is to set out the terms and conditions governing use of the Website, and the rights and obligations of any user accessing, browsing or visiting the Website (hereinafter the “User” or “Users”).
By accessing the Website, and on every visit to it, the User agrees to observe these T&Cs, which apply to all the services available on the Website.

2. ACCESS TO THE WEBSITE
Access to the Website is free of charge. Users must, however, pay the cost of accessing and using the telecommunication network in accordance with their internet service providers’ and telecommunications operators’ terms and conditions.
3. INTELLECTUAL PROPERTY
The entire Website is subject to the international legislation concerning copyright, trademarks, and intellectual property in general, both as regards its form (choices, sitemap, arrangement of contents, means of accessing data, database, or any organisation of data, etc.), and each of the elements of its content (trademarks, text, images, videos, etc.). Such content appearing on the pages of the Website is exclusively owned by LVMH and its contributors, who do not grant any licence or other right to the User other than the right to view the Website.

4. USERS’ OBLIGATIONS AND LIABILITY
Users undertake:

- not to use the Website in a way that might damage, disable, overload, disrupt or compromise its operation or security.
Users acknowledge that they are solely responsible for their use of the Website and for the consequences of such use.
Users must keep their usernames and passwords strictly confidential, and must not in any circumstances communicate them to third parties to enable access to the Website. Users are solely responsible for the actions of any unauthorised user using their user account.
LVMH may at any time, and for any reason, take steps to prevent any User infringing these T&Cs from using the Website, without prejudice to any damages that LVMH reserves the right to claim from that User on those grounds.
5. LVMH’S LIABILITY
LVMH strives to ensure the accuracy of the information published on the Website, and to keep it updated. Accordingly, it reserves the right to correct such information at any time and without prior notice.
To the extent allowed by applicable laws, LVMH disclaims any liability:
- for any ambiguity, inaccuracy or omission concerning the information available on the Website; or
- for any damage caused by a third-party intrusion resulting in an amendment to the information available on the Website, or rendering it impossible to access;
- for any interruption, suspension or malfunction of the Website, or for any loss of data, bugs or viruses, and more generally, for any direct or indirect damage resulting from use of or access to the Website or its contents, whether or not the User is aware of the possibility of such damage.
In this respect, Users confirm that they accept the characteristics and limitations of the internet.
6. AVAILABILITY – MAINTENANCE
LVMH will use its best endeavours to maintain the Website at a reasonable level of operation and availability. However, it reserves the right to restrict Users’ access to and use of the Website, at any time and without prior notice, in order to carry out maintenance operations, or to make changes. LVHM disclaims any liability in the event that access to the Website is interrupted due to such maintenance operations or updates.
7. PERSONAL DATA
LVMH ensures that the personal data of Users of the Website are protected.
LVMH encourages Users of the Website to review the Privacy Policy, which, in particular, contains details of the way in which their personal data are collected, processed, used, transmitted, stored and protected.
8. APPLICABLE LAW AND JURISDICTION
These T&Cs are governed by French law.
Any disputes arising from these T&Cs will be subject to the exclusive jurisdiction of the French courts.
9. LANGUAGE
These T&Cs are drafted in French. If they are translated into one or more other languages, and in the event of a dispute, only the French version will be authentic.

3. WHAT PROCESSING OF YOUR PERSONAL DATA WILL TAKE PLACE?
3.1 Which of Your Personal Data will be processed by the Company?
Appendix 1 of this Policy contains a list of the Personal Data processed in the context of each of the purposes described below.
3.2 How are Your Personal Data collected?
We collect Your Personal Data using the Cookies described in Article 6 and Appendix 1.
3.3 Are You obliged to provide Your Personal Data?
The Data necessary for the Company to achieve the purposes are described in Appendix 1.
3.4 What are the legal purposes and grounds for the Processing of Your Personal Data?
In accordance with the applicable personal data protection regulations, We only collect Personal Data when We have legal grounds for doing so.
The Processing carried out is intended:
- to facilitate Your browsing on the Site; and
- to compile visitor and website audience statistics; based on Your consent; and
- in the case of the Cookies that are strictly necessary, to enable the Site to function; based on Our legitimate interest.
3.5 Who has access to Your Personal Data?
In general, Your Personal Data are accessible:
Within the LVMH Group:
- To the Company’s Institutional Communication Department and Financial Communication Department for the purposes of handling Your requests and questions; and
Among third parties:
- To Our subcontractors and service providers involved for technical reasons (such as the security or maintenance of the Website), or to technical service providers, providers of anti-spam and anti-bot services, etc;
- To any authority, court or other third party when such communication is required by law, by virtue of a regulatory provision or court decision, or when such communication is necessary to protect and defend Our rights.
3.6 How long will Your Personal Data be kept?
Your Personal Data will be kept for the period necessary for the purpose for which they were collected, and in any event, will be destroyed when that period expires.
Appendix 1 contains details of the periods for which Your Personal Data will be kept.
3.7 Transfers of Personal Data outside the European Economic Area
The Company will process Your Data in France. However, We may use certain service providers located abroad, or who themselves use subcontractors located abroad, including outside the European Economic Area (“EEA”) in countries whose data protection regulations differ from those applicable within the EEA.
Your Data will only be transferred outside the EEA with appropriate safeguards in place that comply with the applicable data protection regulations.
Details of transfers of Your Personal Data by the Company are provided in the table attached in Appendix 1.

You have the following rights:
- Right to information: You have the right to obtain clear, transparent and understandable information about how We use Your Personal Data, and about Your rights;
- Right of access: You have the right to access the Personal Data about You that we hold;
- Right to rectification: You have the right to have Your Personal Data corrected if they are inaccurate or outdated, and/or to add to them if they are incomplete;
- Right to erasure/right to be forgotten: You have the right to have Your Data erased or deleted. However, this right may be limited on legal grounds or by Our legitimate interest to retain Your Personal Data;
- Right to object: At any time, You can ask to stop receiving Our communications about Our offers, news and events. You are reminded that in accordance with Article 63 of Law no. 2016-1321 of 7 October 2016 for a Digital Republic, any person may give directions concerning the retention, deletion and communication of their Personal Data after their death. It is Your responsibility to have such instructions implemented.
